​This Agreement is made effective for all purposes in all respects by and between Kambria Fischer Photography, hereinafter referred to as “KFP”, and (your name) hereinafter referred to as “The CLIENT." *Please note, that all CDC and Covid guidelines will be adhered to during your session. Furthermore, KFP does not tolerate any discrimination based on race, religion, background, gender, age, or sexual orientation. If any client does not comply with these standards, all sessions will be cancelled with no refund and this contract will be null and void. Terms & Conditions ​ BOOKING: -Kambria Fischer Photography may reschedule the session if weather conditions will hinder the shoot (such as heavy rain). All attempts will be made to avoid this, however sometimes it is in the client’s best interest to postpone to another date with better conditions. -In the event that the client needs to reschedule the date, Kambria Fischer Photography requires 24 hours notice. In the event of changes to the studio pricelist during that time, prints and product pricing and availability for sessions will apply at the newly booked date. -$150 deposit is due at the time of booking to secure your date (Venmo or PayPal) ​-Payments are non- refundable, but can be transferable in the same calendar year season for another session date if needed to reschedule. -The Regular Session Fee includes up to 7 people per the session. If you have more people, please inquire within. DELIVERY: -All lightly retouched Images will be available online for selection within 14 days of most events unless otherwise specified by client or photographer based on the amount of hours contracted, images specified and post production requests. -Additional editing & Photoshop Work: Images shown in the client gallery include basic retouching. Further custom or client directed retouching is an additional $20 per image. -Due to gallery limits and cost of storage, where an order has not been received and paid for within 30 days of first gallery expiry date, the images will be deleted. - Remaining balance is due on the date of the shoot (cash, Venmo or PayPal) ​-All edited images will not be delivered until final payment has been received. IMAGES: -All images with discretion of the photographer will be retouched and delivered to the client with licensing rights as listed below. -Client will receive all High Resolution images delivered via digital download (includes a print release) and can also purchase prints separately thru the gallery. -The client agrees that KFP owns the Copyright in all photographs. The client gives permission to KFP to use any image of the session for industry competitions and as required subsequent usage and for reasonable general promotional advertising for KFP. The usage for any other purpose (such as use on social media sites) can be negotiated. -The client is welcome to post on social media and tag themselves as well as Kambria Fischer Photography and share these images; however altering the image in any way, including cropping and filters is a breach of Copyright. MEDIA AND COPYRIGHT PERMISSIONS: -As KFP owns the Copyright, when purchasing printed products, the client agrees not to copy, cause to be copied or allow anyone else to copy, photocopy, laser copy or computer scan any images. If clients purchase digital negatives, clients are granted authorization to obtain unlimited reprints for personal use only. The images provided may not be sold, edited, altered (other than resizing for print) or used for any commercial purpose under any circumstances, without written permission. The client will use the photographs and negatives as agreed above and understand that by not doing so is a breach of this agreement and the Copyright Act of 1976. -Other entities related to this property must get permission and are subject to additional fees from KFP before publishing.
